Terms of Service
Effective Date: May 4, 2026 | Last Updated: October 29, 2026
These Terms of Service (“Terms”) form a binding agreement between you and It’s Social Gi (operated by GMC Health and Fitness Inc.). They govern your use of itssocialgi.com, our Kajabi-hosted courses, our community, our coaching products, and any related communications (collectively, the “Services”). By creating an account, accessing a free resource, completing a purchase, or otherwise using the Services, you confirm that you have read, understood, and agreed to these Terms.
1.
Acceptance and Eligibility
You must be at least eighteen (18) years old to purchase any paid product. The Services are intended for individuals operating in good faith. We reserve the right to refuse service, suspend accounts, or terminate access for any reason permitted by law.
2.
Description of Services
It’s Social Gi offers digital education, done-for-you reviews, live cohorts, and private mentorship for aspiring user-generated-content (UGC) creators. Mentorship is capacity-limited and offered by application. The current product ladder is:
- Creator Community — eligible standalone members in the August 2026 transition keep no-cost access through November 13, 2026 at 11:59 PM America/New_York. There is no automatic enrollment, conversion, or billing. Course-bundled access and previously accepted paid terms remain unchanged.
- 30-Day UGC Quick Start — $9 entry-level digital guide. All sales final.
- 90-Day UGC Starter Guide — $27 front-end product.
- Foundation Track — included inside the UGC Pro Accelerator Course and not sold separately. Existing UGC Creator Starter Course purchasers keep the access and terms accepted on their purchase date.
- UGC Written Audit — $147 done-for-you Portfolio Audit of your existing UGC portfolio.
- UGC Strategy Call — $247 sixty-minute live coaching call with Gianna. All sales final. You get one free reschedule with at least 24 hours' notice. If you purchased on or before August 4, 2026, the cancellation terms published on your purchase date still apply to your order.
- UGC Pro Accelerator Course — $297 one-time for the complete 20-module self-paced course, delivered across the Foundation and Professional course areas. It does not renew; checkout offers one payment of $297.00 or a two-payment plan of $159.00 billed monthly for 2 months ($318.00 total).
- The 7-Day UGC Challenge — free to register (email) for a time-bounded live week with one short task a day (the next cohort runs January 1 – 7, 2027). The paid Pro Week track was discontinued on October 29, 2026 and is no longer sold. Challenge purchases made at $97 before October 10, 2026 keep the full $97 credit toward the UGC Pro Accelerator on the terms disclosed at their checkout.
- 1:1 Mentorship — private coaching with Gianna, by application only and capacity-limited. The 12-Week Mentorship (twelve weekly private sessions) is a 3-month commitment: $1,749.97 paid in full, or $1,791 paid as 3 monthly payments of $597; the 4-Week Mentorship (four private sessions) is $997, paid once. Applying does not commit you to purchase. The commitment, rescheduling, missed-session, pause, and cancellation terms are set out in Section 3.1 of our Refund & Cancellation Policy, are shown before you enroll, and form part of these Terms. Earlier mentorship or coaching purchasers keep the terms accepted on their purchase date.
Product availability, pricing, content, and structure may change. We will not change the price you have already paid for an existing enrollment unless required by law.
3.
Accounts and Account Security
You are responsible for keeping your account credentials confidential and for all activity under your account. Course access is licensed to one (1) named individual and may not be shared, resold, or transferred. Sharing course materials or login credentials is grounds for immediate termination without refund.
4.
Pricing, Payment, and Billing
All prices are in U.S. dollars. Payments are processed by Stripe via Kajabi. By completing checkout you authorize the listed charge and any payment-plan installments. Failed payments may suspend access until resolved. Persistently failed payments after thirty (30) days may result in account closure.
4.1 Discount codes
(a) How a code applies. Some links we send apply a discount automatically at checkout. If a code is not applied automatically, enter it in the discount field on the checkout page before you submit payment. Before you pay, check the total shown as "Due now" — that total is the amount we charge.
(b) Codes are limited. A code may expire, may apply only to specific products, and may be limited to one use per customer. Where we offer a code, we state its expiration date and the products it applies to. A code stops working once it expires or reaches its redemption limit, and we do not honor it after that point. Only one discount code applies to an order.
(c) If you did not enter a code. We do not apply a code to an order after the order has been submitted, and we do not issue automatic retroactive price adjustments. If you paid without entering a code you held, email [email protected]. We will consider cancelling and refunding that order so you can purchase again with the code entered. We decide these requests case by case.
(d) If the code failed because of us. If a valid code did not apply because of an error, outage, or misconfiguration on our side — including an error in a link we sent or in a checkout setting we control — and you contact us within thirty (30) days of the charge, we will refund the difference between the amount charged and the discounted amount to your original payment method. On a payment plan, we refund that same difference on each installment charged at the undiscounted amount.
(e) Questions about a code. Email [email protected] about a code that will not work and we will tell you how to proceed. We monitor that address, but we do not promise a specific response time.
(f) Rights not affected. Nothing in this Section 4.1 limits (i) your rights under our Refund Policy, (ii) your right to dispute a charge with your card issuer or bank, including under the Fair Credit Billing Act, 15 U.S.C. §§ 1666–1666j, or (iii) any right you have under federal or state consumer protection law, including the Florida Deceptive and Unfair Trade Practices Act, Fla. Stat. §§ 501.201–501.213. If any part of this Section is held unenforceable, the remainder continues in effect.
4.2 Payment plans
The current UGC Pro Accelerator Course is offered at checkout in two ways, exactly as the checkout's pricing options show: one payment of $297.00, or a two-payment plan of $159.00 billed monthly for 2 months ($318.00 total), with the first $159.00 charged at purchase and the second charged one month later. The two-payment plan is a fixed schedule, not a subscription; nothing renews after the second payment, and access begins when the first payment clears. A missed second payment may suspend access until it is resolved, as described above in this Section. If you bought a legacy offer on an installment plan before August 16, 2026, the installment schedule and total you accepted at checkout remain in effect; that legacy plan does not become a subscription. Failed installments may suspend access until resolved. Any approved refund is calculated from the amount actually collected, subject to the Refund Policy and non-waivable law.
4.3 Subscriptions and auto-renewal
The standalone Creator Community is not presently open for public enrollment. The public subscription price is $19 per month. Eligible existing standalone members keep no-cost access through November 13, 2026 at 11:59 PM America/New_York. After November 13, 2026, eligible members may join the Creator Community at the public price of $19 per month through its checkout, and the membership then renews monthly until cancelled. There is no automatic enrollment, conversion, or billing; silence, existing access, a prior purchase, or a card already on file is not consent to a subscription. Before the Community subscription is made available, its checkout, acknowledgment, and cancellation path must be tested. The checkout will disclose the exact first charge, monthly renewal, applicable tax, refund terms, access timing, and a simple online cancellation method before billing information is submitted. Cancellation stops future charges, access continues through the paid billing period, and there is no cancellation fee.
The ISG Creator Club is a subscription: $47 a month or $470 a year, billed in advance on the same day each period until you cancel. Founding members who joined with the FOUNDING37 code pay $37 a month for as long as the subscription stays active; founding seats are limited to the first 50 redemptions of that code. What the Club includes, how its content is released and the rules that apply to it are in Section 4.4. Cancel any time from your account or by emailing [email protected]; access continues to the end of the paid period and nothing renews after that. Subscription payments already made are not refunded, except where the law of your place of residence requires it. Live Club calls are recorded; a missed call is not grounds for a refund.
Prior paid subscribers retain the price and terms they accepted unless they cancel or affirmatively agree to a different plan. The current $297 UGC Pro Accelerator includes the Foundation and Professional curriculum, the 90-Day UGC Starter Guide, and the First 30 Days guide; it does not include a new Community subscription. Community is sold separately.
If a legacy course purchase or another accepted offer expressly included Community access, that included entitlement remains governed by its accepted terms and creates no separate recurring charge. The $297 UGC Pro Accelerator Course is a one-time purchase and does not renew. A paid Challenge is one-time for that scheduled cohort unless its checkout clearly discloses recurring billing and obtains separate consent. Mentorship is offered by application as described in Section 2 and does not renew automatically; the 12-Week Mentorship payment plan of three monthly payments is a fixed schedule for one purchase, not a subscription.
If we introduce another product that renews automatically, we will disclose the renewal price, the billing frequency, the date of the first renewal charge, and how to cancel, on the checkout page before we ask for your payment information, and we will obtain your consent to those renewal terms separately from your acceptance of these Terms.
4.4 ISG Creator Club: what is included and how it works
(a) What a membership includes. While your Club subscription is active and paid, you have access to: (1) the full UGC Pro Accelerator Course, including its Foundation curriculum, from the day you join; (2) one live group call each week, hosted by Gianna Cestone, Wednesdays at 4:00 PM Pacific Time beginning November 11, 2026, with the last call of each month run as a Rates and Pitch Clinic; (3) recordings of those calls; (4) the Brand Briefs Board, updated weekly; (5) the Opportunity Map, a guide to places where paid user-generated content work is commonly posted, extended weekly; (6) the AI Desk, a weekly AI prompt with instructions; (7) three members-only written posts each week; (8) The Club Letter, a weekly members-only email; (9) the Club community; and (10) access to free 7-Day UGC Challenge cohorts that run during your membership. Nicholas Pagluica may join calls as a guest host.
(b) Weekly release. Apart from the UGC Pro Accelerator Course, which opens in full on the day you join, Club material is released on a weekly schedule. A new member receives everything already released and every release made while the membership is active. We publish an outline of upcoming releases to members; topics, order and formats may change to reflect what members need, and a change in topic is not a change in what the membership includes.
(c) Live calls. Calls are group sessions. We review member work in the order it is submitted, as time allows; we do not promise that any particular submission will be reviewed on a particular call. If we must cancel or move a call, we will tell members in advance where we reasonably can and will reschedule it. A missed call, a moved call or a call you could not attend is not grounds for a refund; the recording is posted for members, normally the same day. Calls are recorded. By speaking, sharing your screen or submitting work on a call, you agree that the recording, including your voice, image and the work you showed, may be made available to Club members. Recordings will not be used in public marketing without your separate written consent.
(d) Founding rate. The founding rate of $37 monthly applies only to the first 50 redemptions of the FOUNDING37 code, on the monthly plan only, one per person, and cannot be combined with any other code. It continues for as long as that subscription remains active and paid. If the subscription is cancelled, or ends because payment fails and is not resolved within the period Kajabi's billing process allows, the founding rate ends; a later membership is billed at the price in effect when you rejoin. When the 50th redemption is used, the code stops applying at checkout.
(e) Price changes. We may change the Club's price for new members at any time. For an existing member, we will give at least 30 days' notice by email before a price change takes effect on a renewal, and you may cancel before it applies. A founding member's $37 rate does not change while the founding subscription remains active and paid.
(f) Yearly plan. The yearly plan is billed $470 in advance and renews each year until cancelled. We will email a reminder at least 15 and no more than 45 days before each yearly renewal, stating the renewal date, the amount and how to cancel online.
(g) Opportunities and third parties. The Brand Briefs Board, the Opportunity Map and any listing, brand name, platform, marketplace, application, agency or contact we share are provided for educational and informational purposes. They are third parties. We are not a talent agency, employment agency, placement service, broker or representative, and we do not act for you or for any brand. We do not verify a brand's, platform's or agency's identity, reputation, payment practices or terms, and we are not a party to, and are not responsible for, any agreement, payment, dispute or relationship between you and a third party. You apply to and deal with third parties directly and at your own discretion. Unless a listing says otherwise, we receive no payment from the third parties named in Club material; if that changes for any listing, the listing will say so. A listing may be filled, changed or withdrawn before you see it.
(h) No guarantee. The Club is education and feedback. We do not guarantee that you will receive a reply, a brand deal, a client, a contract, any number of opportunities, or any income. Many people who take part in creator education do not earn income from it. Your results depend on factors we do not control, including your effort, portfolio, niche, pricing, outreach volume, the market and decisions made by third parties.
(i) AI prompts and tools. AI Desk prompts are drafting aids. AI output can be wrong, generic or inappropriate; you are responsible for reviewing, editing and verifying anything you send, post or submit, and for complying with the terms of any AI tool and any platform you use. Do not use AI, or any other means, to create fake reviews, testimonials, results, credentials, followers or experience, or to misrepresent who you are; the Federal Trade Commission prohibits fake reviews and testimonials, including AI-generated ones. Sending large volumes of unsolicited messages may breach a platform's rules or the law; follow the CAN-SPAM Act and each platform's terms when you do outreach.
(j) Your own disclosures. When you publish content for which you receive payment, free product or another material benefit, you are responsible for disclosing that connection clearly as the FTC's Endorsement Guides and each platform's rules require.
(k) Use of Club material. Club material is licensed to you for your personal use while your membership is active, except that you keep using what you have already applied to your own work (your rate card, your pitches, your portfolio). You may not share your login, record or redistribute calls, or copy, resell or republish Club material, including AI Desk prompts and Teardowns, in whole or substantial part. Accounts that share access may be suspended without refund. When your membership ends, access to the Club, its recordings and its weekly material ends; a separately purchased UGC Pro Accelerator Course is not affected.
(l) Your work in Teardowns. We use a member's work in a Teardown only with that member's permission, and without their name unless they ask to be named. You may withdraw permission for future use by emailing [email protected].
(m) Community conduct. Section 8 (Community Conduct and Standards) applies to the Club community and live calls. Sharing another member's work, contact details or call content outside the Club is a violation of that section.
(n) Changes to the Club. We may improve, replace or retire individual features of the Club. If we remove a feature listed in paragraph (a) without a reasonable replacement, we will tell members by email at least 30 days in advance where we reasonably can, and you may cancel before your next renewal.
5.
Final Sale and Refund Policy
Due to the immediate access provided to digital course content, trainings, templates, resources, and proprietary educational materials, purchases of the UGC Pro Accelerator Course are covered by a 90-Day Conditional Refund Policy. A refund is available only when every eligibility condition in our Refund Policy is met and the request is received within 90 calendar days of purchase; otherwise the purchase is final and non-refundable.
By completing your purchase, you acknowledge that you are receiving immediate access to digital content and agree that you are not entitled to a refund based on change of mind, failure to complete the course, lack of participation, or dissatisfaction with individual results.
Nothing in this policy limits any rights or remedies that cannot be waived under applicable law.
Purchases made before this refund policy became effective remain subject to the refund terms that were presented and accepted at the time of purchase.
Refund and cancellation terms for every other product, including 1:1 Mentorship, are set out in our Refund & Cancellation Policy.
6.
Digital Product Delivery and Access
Digital products are delivered immediately upon successful payment. Access to courses is generally lifetime (so long as the platform exists), unless otherwise stated. Live products (Strategy Call, Challenge and cohort calls, 1:1 Mentorship) are delivered as scheduled.
7.
Intellectual Property Rights
All course content, recordings, templates, scripts, frameworks, and materials are the intellectual property of GMC Health and Fitness Inc. and are licensed to you for personal, non-commercial use. You may use the templates and frameworks in your own UGC business with brands and clients. You may not redistribute, resell, repurpose for a competing course, or create derivative works of the course content itself. Unauthorized sharing is grounds for termination without refund.
8.
Community Conduct and Standards
Community access is a privilege, not a right. We expect respect, good-faith engagement, and adherence to community guidelines. Harassment, spam, recruiting for outside services, sharing course materials externally, or persistent rule violation results in removal without refund.
9.
Earnings and Results Disclaimer
The information and coaching we provide are educational. Income examples, testimonials, and case studies represent specific creators’ results and are not a promise of future earnings. Whether you land paid brand deals depends on your effort, your niche, your local market, and conditions outside our control. By purchasing, you confirm that you understand outcomes vary and that we make no guarantee of any specific income outcome. Our conditional refund terms (Section 5) are conditioned on program completion, not guarantees of earnings.
10.
Testimonials and User Content
Testimonials and student stories on the Services are real and submitted with the student’s consent. Results shown are one person's experience and are not what students generally achieve. We do not hold data on typical student outcomes and make no claim about them. By submitting a testimonial, work sample, or community post, you grant us a non-exclusive, royalty-free, worldwide license to use it for marketing and educational purposes with attribution to your first name (unless you request otherwise in writing).
11.
Third-Party Services
The Services rely on third-party providers (Kajabi, Stripe, Google Analytics, Meta Pixel, PostHog, email service providers) and may link to third-party sites (affiliate offers, partner products). We are not responsible for the policies or practices of those third parties.
12.
Privacy
Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference.
13.
Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including without limitation merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the Services will meet every requirement, will be error-free, or will produce any specific outcome.
14.
Limitation of Liability
To the maximum extent permitted by law, GMC Health and Fitness Inc. and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption. Our total liability for any claim arising out of or relating to the Services is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow these limits; in those jurisdictions, our liability is limited to the maximum extent permitted.
15.
Indemnification
You agree to indemnify and hold GMC Health and Fitness Inc. harmless from any claim, loss, or expense (including reasonable legal fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any third-party right.
16.
Termination
We may suspend or terminate your access at any time for breach of these Terms, for any unlawful activity, or for repeated good-faith complaints from other students. Termination for cause forfeits any refund, conditional or otherwise.
17.
Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Florida, U.S.A., without regard to its conflict-of-laws principles. Disputes arising out of these Terms shall be resolved by binding arbitration in Florida under the Commercial Arbitration Rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual-property disputes.
18.
Class Action Waiver
To the maximum extent permitted by law, you and we agree that disputes will be resolved on an individual basis only. Class actions, collective actions, and class arbitrations are not permitted.
19.
Force Majeure
Neither party is liable for delays or failures resulting from causes beyond reasonable control (natural disasters, pandemics, government actions, third-party platform outages).
20.
Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms together with the Privacy Policy, the Refund & Cancellation Policy, and, for 1:1 Mentorship clients, the Mentorship Agreement constitute the entire agreement between you and us regarding the Services.
21.
Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date will reflect any change. Material changes will be communicated by email or by prominent posting on the Services. Continued use of the Services after the effective date of an update constitutes acceptance.
